1. Introduction
These terms form a legally binding agreement between you and the provider of Wopi ("Wopi," "we," "us," or "our") regarding your use of the Wopi mobile application, related documentation, support communications, and any downloadable or web-hosted legal pages that link to these terms.
Wopi is a cinematic miniature civilization observer. It lets users observe an autonomous micro civilization, adjust climate, time, camera focus, visual quality, motion, weather soundscape, era progress, archive resources, and other app settings. It is not a financial, medical, legal, safety, emergency, or real-world decision-making service.
By installing, opening, purchasing within, or otherwise using Wopi, you confirm that you have read and agree to this Agreement and the Wopi Privacy Policy.
2. Acceptance and Changes
If you do not agree to this Agreement, do not use Wopi. If you use Wopi on behalf of another person or organization, you represent that you have authority to accept this Agreement for that person or organization.
We may update this Agreement from time to time to reflect app changes, legal requirements, security practices, or operating needs. When changes are material, we will take reasonable steps to provide notice, such as updating the effective date, posting a revised page, or showing an in-app notice where appropriate. Your continued use after the revised terms become effective means you accept the revised terms.
3. Eligibility
Wopi is intended for users who are legally able to form a contract or who use the app with consent and supervision from a parent or legal guardian. Wopi is not directed to children under 13, and it is not intended to knowingly collect personal information from children.
If you are a parent or guardian and believe a child provided personal information to us, contact us at wopicyl@163.com. We will take reasonable steps to address the request according to applicable law.
4. The Wopi App
Wopi provides an immersive, visual simulation experience. Features may include a miniature civilization scene, weather and soundscape controls, era evolution, virtual coins, camera and photo archive tools, local image thumbnails, local civilization progress, quality settings, accessibility options, reset controls, and share-sheet export features.
Observation
Autonomous city movement, lighting, weather, time, and era states.
Archive
User-selected images can become local civilization archive resources.
Customization
Visual quality, motion, weather audio, and settings can be adjusted.
We may add, modify, suspend, or discontinue any feature where reasonably necessary for security, compliance, compatibility, maintenance, or product improvement. We do not guarantee that all features will be available on every device, operating system version, region, or network condition.
5. Local-First and Account-Free Use
Wopi does not require a user account by default. Civilization progress, visual quality, motion settings, weather, time, era configuration, wallet balance, processed transaction references, and photo archive files are designed to be stored locally on your device unless a feature or platform service clearly indicates otherwise.
Local data may be lost if you delete the app, reset app data, remove local files, replace your device, restore from an incomplete backup, or use system tools that clear application support data. You are responsible for managing your device, backups, permissions, and local storage.
6. Limited App License
Subject to this Agreement and applicable App Store rules, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to download, install, and use Wopi on compatible Apple devices that you own or control, solely for your lawful personal use.
You may not copy, modify, distribute, sell, lease, sublicense, reverse engineer, decompile, disassemble, attempt to extract source code, bypass technical restrictions, or create derivative works from Wopi except to the extent such restrictions are prohibited by applicable law.
7. User Content and Photo Archives
"User Content" means images, files, messages, feedback, or other materials that you choose to provide, import, capture, share, or send in connection with Wopi. You retain ownership of your User Content.
When you use the camera, photo library, document picker, drag-and-drop, or share features, you represent that you have the rights and permissions needed to use the selected content. You must not import or share content that is unlawful, invasive of another person's privacy, infringing, abusive, exploitative, or otherwise prohibited by applicable law.
Wopi may process selected images locally to create thumbnails, visual signatures, brightness and saturation values, aspect ratios, and other archive details used to present the civilization archive. These local transformations do not transfer ownership of your content to us.
8. Virtual Coins and In-App Purchases
Wopi may offer virtual coins or other paid digital items. Virtual coins are licensed digital content for use only within Wopi. They have no cash value, cannot be redeemed for money, cannot be transferred outside Wopi, and do not create a bank, stored-value, gift card, investment, gambling, or payment account.
In-app purchases are processed by Apple through StoreKit and the App Store. You must follow Apple's payment, refund, tax, family sharing, and account rules. We do not receive your full payment card details. Refund requests for App Store purchases are generally handled through Apple unless applicable law requires otherwise.
We may correct technical errors, reverse fraudulent transactions, remove improperly credited coins, or adjust coin balances where reasonably necessary to protect the app, users, or legal compliance. Paid items may be unavailable if Wopi is discontinued, if your device is incompatible, if your Apple account is unavailable, or if legal or platform restrictions apply.
9. Acceptable Use
You agree that you will not:
- Use Wopi for unlawful, harmful, fraudulent, deceptive, infringing, or abusive purposes.
- Attempt to interfere with app security, payment processing, platform services, or other users' lawful use.
- Use automated tools to exploit, scrape, overload, reverse engineer, or manipulate Wopi.
- Upload, import, or share content that violates privacy, publicity, intellectual property, child safety, consumer protection, or other applicable laws.
- Misrepresent your identity, rights, payment authorization, or relationship with Wopi.
10. Intellectual Property
Wopi, including its software, design, visual interface, simulations, animations, graphics, icons, names, logos, source code, generated world states, and other app materials, is owned by us or our licensors and is protected by intellectual property and other laws.
You may send us suggestions, bug reports, feature ideas, or other feedback. Unless you separately agree with us in writing, you grant us a perpetual, worldwide, royalty-free right to use feedback for any lawful purpose without compensation to you.
11. Third-Party and Platform Services
Wopi may rely on Apple and device-level services, including the App Store, StoreKit, camera, photo library, document picker, share sheet, local file storage, audio session, notifications, accessibility settings, and operating system diagnostics. Those services are governed by their own terms and privacy policies.
We are not responsible for third-party services that we do not control. Your use of Apple services, Apple ID, App Store purchases, refunds, device permissions, backups, and operating system settings is subject to Apple's rules and your agreements with Apple.
12. Privacy
Please read the Wopi Privacy Policy. It explains what information Wopi processes, what is stored locally, how camera and photo archive features work, how purchases are handled, and how users in California, Canada, Singapore, Australia, and other regions can exercise privacy rights.
If there is a conflict between this Agreement and the Privacy Policy about personal information, the Privacy Policy controls for that issue.
13. Disclaimers and Limits of Liability
Wopi is provided on an "as is" and "as available" basis to the fullest extent permitted by law. We do not warrant that Wopi will be uninterrupted, error-free, secure, compatible with every device, or free from loss of local data.
To the maximum extent permitted by applicable law, we will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, goodwill, device functionality, or business opportunities arising from or related to Wopi.
Some jurisdictions do not allow certain disclaimers or limitations. In those jurisdictions, the limitations apply only to the maximum extent allowed by law. Nothing in this Agreement excludes, restricts, or modifies rights that cannot be excluded, restricted, or modified under applicable consumer protection, privacy, or data protection laws.
14. Regional Consumer and Privacy Terms
California
California residents may have privacy rights under the California Consumer Privacy Act, as amended by the California Privacy Rights Act, including rights to know, delete, correct, opt out of sale or sharing, limit certain sensitive personal information uses, and be free from discrimination for exercising rights. Wopi's California privacy disclosures are provided in the Privacy Policy.
Canada
For users in Canada, this Agreement is intended to operate consistently with applicable Canadian privacy and consumer protection requirements. It does not limit non-waivable statutory rights, including rights relating to meaningful consent, access, correction, accountability, safeguards, and challenging compliance.
Singapore
For users in Singapore, Wopi provides public contact information for privacy questions and is designed to support notice, consent, withdrawal, access, correction, protection, retention, and transfer limitation principles under the Personal Data Protection Act where applicable.
Australia
For users in Australia, nothing in this Agreement excludes, restricts, or modifies any consumer guarantees or rights that cannot lawfully be excluded under the Australian Consumer Law or privacy rights that apply under the Privacy Act 1988 and the Australian Privacy Principles.
If a regional law gives you additional mandatory rights, those rights remain in effect even if they are not expressly listed here.
